This session focuses on Small Businesses just entering the Federal Marketplace or those that need a refresher the importance of developing relationships with clients in the Federal Marketplace. Federal Acquisition Regulation 1.602-2(b) mandates that the contracting officer (CO) must “ensure that contractors receive impartial, fair, and equitable treatment.” This session highlights the roles and responsibilities of all stakeholders in project delivery to uphold this mandate. Communication breakdowns, non-compliance, vague project scopes, staff turnover, budget adjustments, and unforeseen conditions often lead to challenges in project delivery. The complexity of projects can further strain relationships between COs and contractors. To foster a positive working relationship, panelists offer practical and proactive steps contractors can take to better engage with COs, with an eye towards improving project outcomes.

The USACE Engineering Pamphlet 34-1-1, Standardization Construction Project Partnering Playbook, 30 April 2022, Chapter 2-1a, states that “Effective partnering requires a long-term commitment to proactive, collaborative, working relationships that maximize the effectiveness of each participant’s resources to achieve successful delivery outcomes. This is accomplished by building and maintaining strong relationships, setting common goals, communicating openly and often, collectively identifying and mitigating risk, solving problems together when they arise, preventing disputes, building trust, understanding each other’s values, team building, and recognizing the implied contractual covenant of good faith.” The panelists will emphasize how partnering can work from their perspective keeping in mind that having a good relationship and strong partnership does not take the place of project delivery, it provides a platform to work through challenges while remaining focused on the task and purpose of the project itself.
