Every year 8(a) firms need to report to the SBA as to their progress in the program. The annual reporting requirements enable the SBA to confirm whether an 8(a) firm remains eligible for the program and is operating in accordance with regulations and goals of the 8(a) program. It is easy for many 8(a) firms to mechanically complete the forms year after year based upon information previously submitted. However, this can lead many firms to overlook changes in their operations and business that need to be accurately reported. A firm that does not complete the report correctly may be the focus of scrutiny as the line between erroneous and false information is often unclear. Firms that submit incomplete or inaccurate information not only face possible program termination, but also potential civil and criminal penalties.
