Description:

Many tribally owned entities assume that sovereign immunity or tribal preference policies will protect them against claims of discrimination and harassment. However, there are limits to the reach of both and many tribally owned entities find themselves surprised when they are required to defend themselves against allegations of discrimination or harassment.  In this session we will explore practical ways to implement a legally compliant tribal preference policy and how to proactively defend against these claims.

  • When sovereign immunity can protect a company against discrimination and harassment claims
  • What is a tribal preference policy and how should it be used
  • How to handle employees that might be subject to different legal standards
  • Special considerations for entities contracting with federal or state governments
